These Terms of Service (“the Terms”) govern the purchase and use of ChatWire, the platform available at https://app.chatwire.net (“the Platform”), provided by Macrofunnels Marketing LLC, 500 4th St NW Suite 102, Albuquerque, NM 87102, United States (“ChatWire” or “we”). By purchasing a subscription or using the Platform, the customer (“the Customer”) accepts these Terms.
1. The service
ChatWire is a software platform that connects WhatsApp Business (through Meta's WhatsApp Business Platform, including coexistence with the WhatsApp Business app), SMS, email and artificial intelligence agents with GoHighLevel and other systems. The features and limits of each plan (sub-accounts, WhatsApp numbers, AI agents, white label and support) are those shown on the Website at the time of purchase.
ChatWire is an independent service and is not affiliated with, sponsored or endorsed by Meta Platforms, Inc. or HighLevel.
2. Who can subscribe
The Platform is intended for businesses and professionals using it in the course of their business, such as agencies and their clients. The Customer declares that they are at least 18 years old and authorized to enter into contracts on behalf of the business they represent.
3. Account
The account is created when the subscription payment is completed. The Customer is responsible for the accuracy of their information, the confidentiality of their credentials and all activity carried out from their account, including that of the users and sub-accounts they create.
4. Plans, pricing and payment
- Subscriptions can be monthly or yearly. Prices are shown in U.S. dollars (USD) and may be subject to applicable taxes.
- Payments are processed through Stripe. The subscription renews automatically at the end of each period for the same length of time, unless the Customer cancels it beforehand.
- We may change our prices. Any change will be announced at least 30 days in advance and will apply from the next renewal.
5. 14-day money-back guarantee
If the Customer is not satisfied, they can request a refund of 100% of the amount paid within 14 days of their first purchase by writing to info@chatwire.net. After that period, amounts paid are non-refundable.
6. Cancellation and account deletion
- The Customer can cancel the subscription at any time from their dashboard. Cancellation stops the next renewal, and the service remains available until the end of the period already paid.
- The Customer can delete their account at any time. Deletion immediately and irreversibly erases the account data, including contacts, conversations and files stored on our servers, so we recommend saving any information you want to keep beforehand.
7. Third-party costs
The subscription price does not include the costs of third-party services. In particular, Meta bills each business directly for WhatsApp messages at its official rates, and the AI, SMS, email, storage or CRM providers the Customer connects bill the Customer under their own terms. ChatWire adds no markup on those rates.
8. Acceptable use and WhatsApp policies
The Customer agrees to use the Platform lawfully and, in particular, to:
- comply with the WhatsApp Business Terms of Service, the WhatsApp Business Policy and the WhatsApp Commerce Policy;
- obtain consent (opt-in) from their contacts before messaging them and honor opt-out requests immediately;
- not send spam, unsolicited bulk messages or any unlawful, misleading or offensive content, or content that infringes third-party rights;
- use Meta-approved templates to start conversations outside the 24-hour customer service window;
- use AI agents for their business's customer service and communications, supervise their replies and offer the option to talk to a person. Using the Platform to offer general-purpose AI assistants over WhatsApp is not allowed;
- inform their contacts, where required by law, that they may be interacting with an automated system.
Meta may restrict or suspend WhatsApp numbers or accounts that breach its policies, and ChatWire is not responsible for those decisions. We may suspend access to the Platform if we detect use that breaches these Terms or puts the service, other customers or our relationship with Meta at risk.
9. Third-party services connected by the Customer
The Platform works with services the Customer connects using their own accounts and credentials: GoHighLevel, AI providers (such as OpenAI, Anthropic, Google or OpenRouter), SMS providers, email servers, storage (S3 or Cloudflare R2), n8n, Chatwoot or Cal.com. The Customer is responsible for complying with their terms, for their costs and for the data they choose to send to them. We are not responsible for the availability, operation or output of those services, including responses generated by AI models.
10. Data protection
The Customer is the controller of their contacts' personal data and ChatWire acts as processor. In that capacity, we undertake to:
- process the data only to provide the service and according to the Customer's documented instructions, which include the configuration they set up on the Platform;
- ensure the confidentiality of the people authorized to process the data and apply appropriate security measures;
- use only the sub-processors listed in the Privacy Policy (mainly netcup GmbH, for hosting in Germany) and inform the Customer of any change;
- help the Customer respond to data subject requests and meet their security and breach notification obligations;
- delete the data when the service ends or when the Customer deletes their account;
- make available to the Customer the information needed to demonstrate compliance with these obligations.
The Customer warrants that they have a legal basis to process their contacts' data and to share it with the services they connect. All other processing is described in the Privacy Policy.
11. Availability and support
We work to keep the Platform continuously available, but we do not guarantee uninterrupted service: there may be interruptions due to maintenance, updates or causes beyond our control, including changes or incidents in third-party services such as Meta or GoHighLevel. Support is provided through the channels included in each plan.
12. Intellectual property
The Platform, its software and the ChatWire brand belong to Macrofunnels Marketing LLC. During the subscription we grant the Customer a non-exclusive, non-transferable right to use the Platform. The Customer's data and content belong to the Customer. With white label, the Customer may offer the Platform to their own clients under their brand and is responsible for how those clients use it.
13. Limitation of liability
To the extent permitted by law, ChatWire shall not be liable for indirect damages, loss of profits, loss of data or business, or damages arising from third-party services or from Meta's decisions regarding the Customer's WhatsApp accounts. ChatWire's total liability to the Customer is limited to the amount paid by the Customer in the 12 months preceding the event giving rise to it.
14. Changes to the Terms
We may change these Terms. Significant changes will be announced at least 15 days in advance by email or in the dashboard. If the Customer does not agree, they can cancel their subscription before the changes take effect.
15. Governing law and jurisdiction
These Terms are governed by the laws of the United States of America. Any dispute shall be submitted to the courts of Albuquerque (New Mexico, United States), unless applicable law mandatorily establishes a different venue.
