This policy explains what personal data we process at ChatWire, why, on what legal basis, who we share it with, how long we keep it and how you can exercise your rights. It applies to:
- people who visit the website https://chatwire.net (“the Website”);
- customers who subscribe to and use the ChatWire platform at https://app.chatwire.net (“the Platform”) and their authorized users;
- our customers' contacts whose data is processed through the Platform, including data obtained through Meta's WhatsApp Business Platform.
1. Data controller

We are the controller of the data of Website visitors and of our customers. As for the data of our customers' contacts (for example, people who message a business that uses ChatWire on WhatsApp), the controller is the customer and we act as a processor, following the customer's instructions and in accordance with the Terms of Service.
2. What data we process
2.1 Website visitors
- Technical data: IP address, browser and device type, pages visited and date and time of access, logged by the servers for security and operational purposes.
- Cookies: necessary technical cookies and, only if you accept them, analytics (Google Analytics) and advertising (Meta Pixel) cookies. See the Cookie Policy.
- Communications: the data you provide if you write to us by email.
- Access requests: name, email address, phone number, company (optional) and plan of interest, if you fill in the “Request access” form.
2.2 Platform customers
- Identification and contact: name, email address, company and account login details.
- Billing: plan purchased, amounts and payment history. Card details are processed directly by Stripe; we do not store full card numbers.
- Configuration: sub-accounts, connected numbers, AI agents, knowledge bases, white-label preferences and the credentials or API keys you enter to connect your own services (GoHighLevel, AI, SMS, email or storage providers).
- Usage and support: account activity logs and your communications with our support team.
2.3 Data processed on the Platform on behalf of our customers
- Contact data: name, phone number and WhatsApp profile name of the people who communicate with the customer.
- Content of communications: text messages, voice notes, images, documents and other files sent or received via WhatsApp, SMS or email.
- Metadata: date and time, delivery and read status, and the number or channel used.
- CRM data: contacts, notes, tags and appointments synced with the customer's GoHighLevel account or other systems they connect.
This data comes from Meta's WhatsApp Business Platform, the customer's GoHighLevel account and the SMS and email providers the customer connects.
3. Purposes and legal bases
- Providing the contracted service: creating and managing the account, connecting channels, sending and receiving messages, syncing them with the CRM and running the AI agents configured by the customer. Legal basis: performance of the contract.
- Managing payments and billing and complying with legal, tax and accounting obligations. Legal basis: legal obligation and performance of the contract.
- Answering questions and providing support. Legal basis: performance of the contract or, if you are not a customer, our legitimate interest in replying to you.
- Handling your access request and contacting you by email, phone or WhatsApp to activate your account. Legal basis: steps taken at your request prior to entering into a contract.
- Keeping the Website and the Platform secure and preventing fraud and abuse. Legal basis: legitimate interest.
- Sending our customers service communications (changes, incidents and relevant updates) and, where applicable, information about similar services, with an unsubscribe option in every email. Legal basis: performance of the contract and legitimate interest.
- Measuring Website usage and showing relevant advertising through Google Analytics and the Meta Pixel. Legal basis: your consent, which you can withdraw at any time.
The data we process on behalf of our customers (section 2.3) is used solely to provide the service to them and according to their instructions. The legal basis for that processing is the responsibility of the customer as controller.
We do not make decisions based solely on automated processing that produce legal effects concerning you. AI agents reply according to the configuration defined by each customer, and the customer can step into any conversation.
4. Data obtained from Meta's WhatsApp Business Platform
When a business connects its WhatsApp Business account to ChatWire through Meta's Embedded Signup, it authorizes us to access the WhatsApp Business Platform on its behalf. Regarding that data:
- We use it exclusively to provide the service to that business: sending and receiving its messages, displaying them in its dashboard, syncing them with its CRM and, if enabled, running the AI agent it has configured.
- We do not sell it, we do not use it for advertising or profiling, and we do not use it to train artificial intelligence models.
- We only share it with the providers needed to deliver the service (section 5) and with the services the business itself chooses to connect.
- When the business enables an AI agent, the necessary conversation content is sent to the AI provider the business has configured, using its own API key, solely to generate the reply.
- It is kept while the business's account is active and is deleted immediately and permanently when the business deletes its account or asks us to. See the data deletion instructions.
The use of WhatsApp is also subject to the terms and privacy policy of WhatsApp and Meta.
5. Recipients and providers
We do not sell or rent personal data. We only share it with:
- netcup GmbH (Daimlerstraße 25, 76185 Karlsruhe, Germany): hosting of the Website and the Platform on servers located in Germany.
- Stripe: payment processing and subscription management.
- Meta Platforms: sending and receiving messages through the WhatsApp Business Platform and, only with your consent, the Meta Pixel on the Website.
- Google: Google Analytics on the Website, only with your consent.
- Services the customer connects with its own accounts: GoHighLevel, AI providers (such as OpenAI, Anthropic, Google or OpenRouter), SMS providers (such as Twilio), email servers, own storage (S3 or Cloudflare R2), n8n, Chatwoot or Cal.com. These services receive data at the customer's choice and process it under their own terms and policies, which the customer accepts directly with them.
- Our sales management tools (CRM and automation), to follow up on access requests.
- Public authorities, where required by law.
6. International transfers
The Platform and its data are hosted in Germany, within the European Union. Macrofunnels Marketing LLC is established in the United States, and some providers (such as Stripe, Google, Meta or the AI providers chosen by the customer) may process data outside the European Economic Area. In those cases, transfers rely on appropriate safeguards, such as the provider's participation in the EU-U.S. Data Privacy Framework or the Standard Contractual Clauses approved by the European Commission.
7. Data retention
- Account and Platform data (configuration, contacts and conversations): while the account is active. When the account is deleted, it is erased immediately and irreversibly.
- Media files (audio, images and documents): if the customer has not configured its own storage, they are kept on our netcup servers in Germany while the account is active. If it has (S3 or R2), they are stored there, under its control.
- Access requests: up to 12 months if you do not become a customer; they are then deleted automatically.
- Billing data: for the periods required by tax and accounting laws.
- Technical and security logs: for the time strictly necessary to keep the service secure.
- Cookies: for the periods stated in the Cookie Policy.
8. Your rights
You can exercise your rights of access, rectification, erasure, restriction of processing, portability and objection at any time, and withdraw any consent you have given, without affecting the lawfulness of prior processing.
- Customers: you can edit your data or delete your account directly from your dashboard at https://app.chatwire.net.
- Anyone: write to info@chatwire.net with the subject “Data protection” and state the right you want to exercise. We will reply within one month at the latest.
- Our customers' contacts: if you have messaged a business that uses ChatWire, please contact that business first, as it is the controller of your data. If you write to us, we will forward your request to the business and help it respond.
If you believe we have not handled your data correctly, you can lodge a complaint with the data protection authority of your country of residence; in Spain, the Spanish Data Protection Agency (www.aepd.es).
9. Security
We apply appropriate technical and organizational measures to protect data against loss, unauthorized access or alteration: encrypted HTTPS/TLS connections, access control to our systems, hosting in data centers in Germany and access limited to the staff who need it to provide the service.
10. Minors
ChatWire is a service for businesses and professionals and is not intended for anyone under 18.
11. Changes to this policy
We may update this policy to reflect legal or service changes. The version in force is the one published on this page with its last updated date and, if the changes are significant, we will notify customers by email or in the dashboard.
